Vineland, NJ - Residents near the Vineland DataOne Data Center have filed a class action lawsuit against DataOne USA LLC, the owner and operator of the data center. The complaint is built on three causes of action: Private Nuisance, Public Nuisance, and Negligence.
Two residents filed the class action complaint in federal court alleging that about 1,000 residential properties within 1 mile of the data center, owned and operated by DataOne USA LLC are similarly impacted by noise from the facility. The lawsuit alleges that residents have lost their ability to use and enjoy their property and the loud noise from the data center is also causing damage to property values.

The Vineland Data Center, located at 3963 S. Lincoln Ave, is situated on a campus that remains under construction but features at least three fully operating data rooms. To power its equipment, the data center will require around 300 megawatts (MW), which is the energy demand of a small city. However, DataOne is increasing its size and will be approximately a 2.6 million square foot complex, where it will house a system of servers that will provide artificial intelligence computing and hosting services.
“Data Centers like the Vineland Data Center can generate significant noise pollution from diesel generators and heating, ventilation, and air conditioning (HVAC) systems, including chillers, cooling towers, air-handling units, and condenser fans. These systems may create persistent industrial noise.”
According to one of the named plaintiffs, Michael Gentile, it’s a “very loud industrial noise. Sounds like a helicopter hovering, loud fans like you’re at an airport. Humming noise. Sometimes you hear it in the house. Sometimes when you step outside on my porch.”
The plaintiffs are represented Cohen & Riechelson.
DataOne provided the following statement to VinelandToday.com regarding the lawsuit, “DataOne is aware of the recently filed lawsuit regarding noise concerns around the Vineland data center. Because this matter is now subject to legal proceedings, we are unable to comment on the specific claims.” adding “In recent months we have been actively working with local stakeholders to address community concerns. We have already implemented a number of noise mitigation measures, and continue to evaluate additional improvements on an ongoing basis as construction activities are completed. We remain committed to constrictive dialogue, and being a valuable and responsible member of the community for the long term.”
