Vineland, NJ - The New Jersey Department of Environmental Protection has announced that it has fined DataOne, the operator of the Vineland Data Center, over $1.07 million for violations of the New Jersey Air Pollution Control Act for installing 62 large “natural-gas power generators” without requisite DEP permits.

The DEP’s Administrative Order and Notice of Civil Penalty Assessment (AONOCAPA) stems from a site inspection that took place on July 29th, during which the power generators were observed. The power generators were not observed during the DEP’s last previous site inspection that occurred during December 2025.

“This enforcement action - by far the largest ever taken against a data center in New Jersey and possibly one of the largest such actions in the nation - sends a clear message that these facilities will not be constructed or operated with impunity in this state,” said DEP Commissioner Ed Potosnak.

The Sherrill administration has committed to a “comprehensive, four-pillar plan” to ensure the development of AI infrastructure in New Jersey is done responsibly. This plan includes: establishing fair-share rules, improving transparency, developing strong statewide standards for Community Benefits Agreements, and delivering good paying jobs.
